All Star Safety Ltd – Website Terms & Conditions for NVQ & Course Bookings
(Last updated 11th November 2025 – applies to all bookings made through our WooCommerce shop, by email or by telephone)
1. Definitions “We/Us/Our” means All Star Safety Ltd (company number 11979554) of Suite 3.03, Suffolk Enterprise Centre, Felaw Maltings, 44 Felaw Street, Ipswich IP2 8SJ. “You/Your” means the person, firm or company making the booking. “Course” means any open, in‑house or on‑site taught programme (for example First Aid, IOSH, NPORS, CPCS, lifting‑operations training). “NVQ” means any National/Scottish Vocational Qualification, Diploma or Certificate delivered by us through face‑to‑face, blended or remote assessment. “Services” means the delivery of any Course or NVQ and any associated materials, e‑portfolio access, registration, certification or support.
2. Formation of Contract
- A binding contract is created when we issue written confirmation of your order (automated via WooCommerce or by email) and full payment (or any agreed deposit) is received.
- It is your responsibility to check the confirmation and advise us immediately of any errors or special requirements.
3. Pricing & Payment
- Prices shown on the website are exclusive of VAT unless stated otherwise.
- Courses – payment in full is due 30 calendar days prior to the start date.
- NVQs – payment in full is due before registration unless we have agreed in writing to a 50 % / 50 % split (final balance payable before certification). Certificates/competent‑operator cards will not be released until all sums are settled.
- We accept payment by bank transfer, debit/credit card or any other method advertised at checkout.
- Late payments attract interest at 8 % per annum above the Bank of England base rate plus reasonable debt‑recovery costs (Late Payment of Commercial Debts Regulations 2002).
4. Your Statutory “Cooling‑Off” Rights (Distance Contracts)
- Where you are a consumer (individual acting outside your business) and book online or by phone, you may cancel within 14 days of receiving our confirmation and obtain a full refund.
- If the Course starts, or the NVQ registration is processed, within those 14 days, you agree that the service has begun and the right to a full refund is lost; you will pay for any proportion of services already supplied (Consumer Contracts Regulations 2013).
5. Booking Transfers, Cancellations & Refunds (Business & Consumer)

* NVQ registrations: Awarding‑body fees, e‑portfolio fees and any cards already ordered are non‑refundable once incurred. Candidate substitutions after registration incur additional charges. The above fees also apply where:
- insufficient delegates, facilities or equipment are available on site;
- delegates fail to attend or are refused entry under the Conduct policy (clause 6).
6. Conduct & Behaviour
- We are committed to providing a safe, inclusive and respectful learning environment. You must behave professionally and courteously towards our staff and other learners at all times.
- Rude, aggressive, discriminatory, intimidating or otherwise unacceptable behaviour (determined at our reasonable discretion) will result in your immediate removal from the Course or NVQ without any refund. We may also exclude you from future bookings.
- Alcohol or illegal drug use is prohibited. Delegates must be medically fit to undertake practical activities and speak sufficient English to follow safety instructions.
7. Malpractice including use of AI and/or plagiarism
All learners are expected to conduct themselves in a professional and honest manner throughout the duration of the course or NVQ programme. Any form of academic dishonesty, including but not limited to plagiarism, use of AI-generated content, or copying work from others (past or current learners), is strictly prohibited and will be treated as malpractice.
Plagiarism is defined as submitting work that is not the learner’s own without appropriate acknowledgement of the source. This includes copying from online sources, other learners’ work, or published materials without proper citation. The use of generative AI tools (such as ChatGPT or similar) to complete assignments or assessments is not permitted unless explicitly authorised in writing by the centre.
All submitted written work is subject to review using AI-detection software (including but not limited to GPTZero). If the results indicate a 50% or higher confidence that content has been AI-generated, the work will be flagged and the learner will be contacted to discuss the submission. If, after discussion, the centre reasonably concludes that the submission is not the learner’s own original work and was produced using AI or through other dishonest means, the learner will be withdrawn from the course or NVQ without refund and will not be eligible to receive a certificate.
Other examples of malpractice include, but are not limited to:

Submitting another individual’s work as your own.

Copying from or collaborating with other learners where not permitted.

Falsifying evidence or documentation.
The centre reserves the right to take appropriate disciplinary action, including withdrawal from the course or qualification without refund, where malpractice or misconduct is identified.
8. Specific Conditions for NVQs
- Contact Requirement – you must maintain meaningful contact with your assessor or centre staff (e.g. responding to messages, submitting evidence, attending planned sessions). If we receive no contact for 90 consecutive days, we will withdraw you from the NVQ without refund.
- Targets & Progress – your assessor will agree realistic targets in your Individual Learning Plan. Failure to meet targets and refusal or inability to commit to revised targets may lead to withdrawal.
- Maximum Duration – Level 2‑3: 12 months; Level 4‑7: 18 months. Extensions are chargeable at 50 % of the original fee per additional year.
- All evidence must be authentic, generated by you and, where required, verified by supervisors. AI‑generated or plagiarised answers will be rejected and repeated offences may lead to withdrawal without refund.
- Assessment cannot start until you are registered with the awarding organisation. Any evidence gathered before registration will be deleted and must be redone.
9. Specific Conditions for On‑Site / Client‑Premises Courses You must provide, at your cost: safe, compliant plant/equipment, suitable loads, a clean classroom with power and projection facilities, and adequate PPE for delegates. Delegates must be free from normal work duties and attend for the full duration.
10. Cancellation or Amendment by Us We may postpone, relocate or cancel a Service for reasons beyond our control (e.g. trainer illness, adverse weather, force‑majeure). We will offer an alternative date or full refund; our liability shall not exceed the fee already paid.
11. Certificates, Cards & Results Certificates, unit transcripts and competent‑operator cards are issued only when:
- the learner has successfully completed all requirements; and
- full payment has cleared.
Digital certificates may be provided where available.
12. Intellectual Property & Learning Materials All training materials, e‑learning content, videos and documentation remain our intellectual property and may not be copied, shared or used for any commercial purpose without prior written consent.
13. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or any matter that cannot be excluded under the Consumer Rights Act 2015.
- Subject to 12.1, our total liability for any loss or damage shall not exceed the price paid for the relevant Service. We are not liable for indirect or consequential loss (including loss of profit, business or reputation).
14. Force Majeure We shall not be in breach of these terms nor liable for delay or failure to perform where such delay or failure results from events beyond our reasonable control (including but not limited to acts of God, epidemic, strike, equipment breakdown or civil unrest).
15. Data Protection We process personal data in accordance with UK GDPR and our Privacy Notice (available on the website). Candidate details are shared only with relevant awarding organisations and accrediting bodies for the purpose of registration, quality assurance and certification. Data is retained for up to seven years.
16. Complaints & Dispute Resolution If you are dissatisfied, please notify us in writing within 14 days of the issue. We will investigate and respond within 10 working days. If the matter cannot be resolved, we may, by mutual agreement, refer it to independent mediation (in accordance with the Centre Handbook and Awarding Organisation guidance). Where you paid by credit or debit card, Section 75 of the Consumer Credit Act or charge‑back rules may apply. These terms provide clear evidence of the contract and performance to assist card issuers in deciding any dispute.
17. Governing Law & Jurisdiction These terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim. By completing a booking on our website, submitting a booking form or paying an invoice you confirm that you have read, understood and agree to be bound by these Terms & Conditions.
NVQ Assessment Process (Updated 11 Nov 2025)
An NVQ (National Vocational Qualification) is designed to assess your competence in a specific occupational area through real work performance. Your assessor will gather evidence through verbal or written questions, direct observation, professional discussions, photos, videos, workplace documents, and, where applicable, witness testimonies from supervisors or colleagues.
PLEASE NOTE – All NVQs must be completed in English. Learners must have a reasonable level of spoken and written English to undertake the assessment.
Organising Your Assessment
Once registered, you will be assigned an assessor who will contact you to arrange an induction. During this induction, your experience, skills and knowledge will be reviewed, and an Individual Learning Plan (ILP) will be created. This outlines how you will meet the NVQ requirements and the targets for completing your qualification.
You must liaise with your employer or site manager to ensure your assessor has suitable access to observe you on-site and gather evidence. If access is not arranged, this may delay your assessment and incur additional charges (see “Wasted Visit Fee” below).
Duration

Level 2–3 NVQs must be completed within 12 months of registration.

Level 4–7 NVQs must be completed within 18 months of registration.
Extensions beyond these limits will be subject to a charge of 50% of the original fee per additional year.
Maintaining Contact & Progress
You are expected to maintain regular and meaningful contact with your assessor and centre staff throughout your NVQ. This includes responding to messages, submitting evidence, attending scheduled reviews, and meeting agreed targets in your Individual Learning Plan.
If there is no contact for a continuous period of 90 days, or if you fail to meet your targets and are unwilling or unable to agree revised targets, you will be withdrawn from the qualification without refund.
Site Access Requirements
You are responsible for:

Providing your assessor with contact details for a supervisor or site manager.

Ensuring your assessor is inducted and has permission to access the site.

Being available to carry out normal work activities during the assessment visit.
Failure to make adequate arrangements may result in a wasted visit fee of £250. If the visit goes ahead but is delayed due to inadequate arrangements, a charge of £50 per hour will apply.
Assessment & Authenticity
Your assessor will use a range of assessment methods in line with the NVQ assessment strategy, including:

Witness testimony
All evidence must be your own work. AI-generated, plagiarised or falsified work will be rejected. Repeated breaches may result in withdrawal from the qualification without refund.
Assessment cannot commence until you are fully registered with the awarding organisation. Any evidence gathered before official registration will be deleted and must be redone.
CITB Health, Safety and Environment Test
For your CPCS/NPORS card to be upgraded from Red to Blue, in addition to completing your NVQ you will need to have an up to date H&S test. This must be at the required level for your card category, and within 2 years on your application to upgrade. Please inform us if you need to take another H&S touch screen test and we can arrange this for you, at an additional cost.
Red Card extension
When registering to complete your NVQ, your CPCS/NPORS Red Trained Operator Card can be extended for an additional 12 months if you have not already had an extension for this category. If you wish to do this please inform us below and we can extend your card, however there is an additional charge to do so.
General terms and conditions
- We must receive payment in full before the NVQ commences.
- Cost is exclusive of VAT at the current rate.
- Candidates must have an up to date pass in the relevant H&S touchscreen test once their NVQ is complete for CPCS/NPORS Red to Blue upgrades, or CSCS Card Orders. This can be arranged by All Star Safety at an additional cost.
- No certification will be issued until full payment has been received.
- All NVQ certification takes up to 8-12 weeks to be issued by the awarding body.
- All delegates must have the correct personal protective clothing required i.e. hard hat, overalls, protective footwear etc.
- If training is to be held at your own premises the venue must meet the required standards.
- Any equipment used for training must have all relevant inspection certificates and these must be available for the assessor/trainer.
Additional Fees
Wasted visit/delay fee:-
If your assessor confirms a date to visit you on site, it is your responsibility (and your employer’s) to ensure that all necessary arrangements have been made. This includes providing full site details, informing the site manager and gaining permission for assessor access, ensuring the assessor is expected on site, and advising them of any induction requirements. You must also ensure that the required plant, equipment, and machinery relevant to your qualification are present and in use on the day of assessment, so the assessor can carry out the necessary observations and evidence gathering. If these arrangements are not in place and the assessor is refused access or unable to begin their work, the visit may be cancelled, and a wasted visit fee of £250+VAT will be charged. If the visit goes ahead but the assessor is delayed due to lack of access, site readiness, or missing equipment, a fee of £50+VAT per hour will apply.
Unique Learner Number
As part of the NVQ registration process we are required to issue you with a Unique Learner Number (ULN). This will be linked to a Personal Learning Record containing information on your qualifications, awards and learning achievements under the Qualifications and Credit Framework (QCF).
